We are NOT responsible for your injury or death, loss of property, damage to property or loss of expenses as a result thereof. If you are unsure or have questions about any of our liabilities it is your responsibility to ask up front and before you engage any activity.

We will not make any representation for any foreign entity, government or person. We will not represent you in any matters pertaining to any grievance or loss that result in legal fees in the United States or in a foreign government. We are not responsible for acts of God, crime or terrorism.

By accessing, reading, scanning, downloading, browsing on any of the information within this site, window, picture, form, tab, URL etc., you agree to be bound by these conditions, you understand these conditions and that this document becomes a legal and binding agreement – similar to a written contract – and that you willingly enter into this binding agreement. No officer or employee of Global HCF can change this agreement without a written and signed document.

Arbitration

Except as otherwise expressly provided in this User Agreement, any dispute or claim arising under or with respect to this User Agreement will be resolved by arbitration under the provisions of the State of Tennessee. The arbitrator in any proceeding may award reasonable costs and expenses, including reasonable attorneys’ fee, to the prevailing party.

Your Privacy is paramount to us. However, to perform our jobs it is required that we collect certain private and personal information about you. We use this information in various manners. Some of these are to help you select a destination and medical procedure, doctor, medical facility or home and to help validate your qualifications for certain homes, government plans and programs. We also use it to process payments for you and us. We may report this information to a credit agency (s), doctors, insurance agencies, lawyers, third party affiliates who do business with us, hospitals, and healthcare providers. By sending us your information you are “implying consent” for us to use it in this manner. We may give information to law enforcement officials at their lawful request.

This being said, the protection of your privacy is very important to us. We do not sell or give any of your personal information to anyone that does not have a legitimate business or lawfully purpose for it.

Payment Arrangements and Terms

All payments must be received 6 weeks prior to departure. This must be in any acceptable form of payment that is agreed upon by both parties. Payment is made in United States dollars.

Cancellation & Changes

Cancellations and Changes, once arranged are difficult to modify or change. Government visa’s transportation charges, fee’s, airfares, services, rentals, bookings, reservations, labs, appointments, etc may or may not be refundable. Global Health Care Facilitators, LLC can not control many of these costs and accepts no liabilities for them. As such cancellation charges and costs may be very high and the return of any money to you may take several weeks or months to process. Global Health Care Facilitators, LLC may charge a cancellation fee. Once you have committed please understand that we are limited in our ability to cancel these arrangements and charges.

Description of Service

Global Health Care Facilitators, LLC is the premier housing locator and medical tourism service agent worldwide. Our services include routine travel packages to foreign countries for medical and dental treatment and recuperation. We gather information; enter into contracts as third party marketing providers for healthcare facilities. We locate homes for the elderly, infirmed, disable, and people who need assisted living, Alzheimer’s or nursing home placement. During this process we provide you with information that is generally available in the market so YOU CAN MAKE INFORMED DECISIONS ABOUT YOUR MEDICAL TREATMENT OPTIONS.

Not a Medical Provider, a Referral Service or Government Agency.

Global Health Care Facilitators, LLC does not employ doctors or medical staff in any capacity that can or will enter into or make decisions concerning your healthcare. As facilitators we “facilitate” or “liaison” between doctors and hospitals, facilities, nursing facilities and other healthcare providers – and do so at your explicit request. We do not endorse, recommend or approve any hospital, doctor (MD or PhD) travel agency, entity, government or organization. Global Health Care Facilitators, LLC is not a medical referral service. Only a medical doctor can advise you on your medical options and provide medical opinions. You are responsible for determining the qualifications and general fitness of the doctor or facilities that you choose. All issues are between you and your doctor, the facilities or their administrative faculty and you are advised to discuss all medical conditions so they are aware of your unique situation.

Choosing the proper doctor, vetting his abilities and ensuring the correct facilities and recovery locations and practices are a responsibility that you must assume. At no time does Global Health Care Facilitators, LLC assume this practice for you. We do not accept responsibility or liability- prior to, during or after treatment or recuperations- for doctors (MD or PhD), dentists, nurses, healthcare givers, foreign or domestic government agencies or any entity for any treatment, advice, or malpractice that results in you’re choosing of the procedure, services, doctor (MD or PhD), facility or travel. You agree to assume all responsibility in connection with choosing any doctor and travel for your desired procedure.

Liability Limitations

You agree that Global Health Care Facilitators, LLC, its assigns, officers, members, associates, insurance companies, employees, owners (s), advisors, physicians, nurses, officers, directors, members of the board, domestic or international affiliates, loan agencies, banking institutions, contractors, representatives, appointees, agents and solicitors, in person or acting for Global HCF will not be held liable for the use of this site, the information contained therein or services resulting thereof. It is recommended that you understand these limitations by having your own attorney review them and explain them to you.

You agree that Global Health Care Facilitators, LLC, its assigns, officers, members, associates, employees, officers, owners (s), advisors, physicians, nurses, directors, members of the board, domestic or international affiliates, contractors, third parties, loan agencies, banking institutions, representatives, insurance companies, appointees, agents and solicitors, personally or representing the company, will not be responsible for any damages and held harmless (direct, indirect, special, punitive or consequential) that arise from your use of this site, arrangements, services, products, actions or information. You agree to this whether the parties have prior knowledge or been advised of possible damages prior to your claim. Specifically covered under this agreement is loss of life, injury, malpractice, damage to person or property, loss of money, delay or inconvenience. If you disagree in part or in whole of this agreement you may not use our site, name or services and our relationship is terminated.

It is also your wish and instruction (whether deceased or alive) that your family, assigns, estates and associates agree that Global Health Care Facilitators, LLC, its assigns, officers, members, associates, employees, officers, owners (s), advisors, physicians, nurses, directors, members of the board, domestic or international affiliates, contractors, third parties, loan agencies, banking institutions, representatives, insurance companies, appointees, agents and solicitors, personally or acting for the company, will not be responsible for any damages and held harmless (direct, indirect, special, punitive or consequential) that arise from your use of this site, arrangements, services, products, actions or information. You agree to this whether the parties have prior knowledge or been advised of possible damages prior to your claim. Indemnity

You agree to defend, indemnify, and hold harmless Global Health Care Facilitators, LLC, its assigns, officers, members, associates, employees, officers, owners (s), advisors, physicians, nurses, directors, members of the board, domestic or international affiliates, contractors, third parties, loan agencies, banking institutions, representatives, Insurance companies, appointees, agents and solicitors, either personally or acting on behalf of the company, from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses including attorneys' fees and litigation expenses, relating to or arising from…

Your Venue

You agree that the use of this site and the Liabilities, Privacy, Terms of Use, Disclaimers and Consent information constitutes a User Agreement and contract and shall be governed by and construed in accordance with the law of the State of Tennessee. We agree that any legal action or proceeding under or with respect to this agreement may be brought in the courts of the State of Tennessee or the United States having jurisdiction in Putnam County; and for the purpose of any such legal action or proceeding, you hereby submit to the jurisdiction of such courts. You hereby agree not to raise and you will waive any objection to or any defense based upon the venue of such courts and any objection or defense based upon an inconvenient forum. You also agree not to bring any legal action or proceeding under or with respect to this agreement outside Putnam County, Tennessee unless, for some reason, the courts of the State of Tennessee and the federal courts having jurisdiction in Putnam County refuse or do not have jurisdiction in the matter.

Travel Documents

The TSA, U.S. State Department and other government agencies and other governments and their agencies require that you have a passport. Many countries require visas. Global Health Care Facilitators, LLC will assist you with all visa requirements. Global Health Care Facilitators, LLC cannot guarantee that you will be granted any of these documents.

Costs

All process and payments are to be in U.S. dollars. Because of currency fluctuation, unique medical situations, location and other reasons, prices may vary.
